*INTRODUCTION*

*United Nations Development Programme (UNDP) aims to synchronize government
priorities with the citizens' immediate expectations to further develop and
entrench democratic values in society - for the consolidation of a truly
democratic political system. Through its Governance Reform and DPRD
Empowerment (GRADE) Project in partnership with the Directorate General of
the Regional Autonomy of the Ministry of Home Affairs, UNDP is facilitating
efforts to strengthen the capacity of the local parliamentarians (DPRD) and
to enhance the accountability and functioning of the DPRD in implementing
core functions i.e. of legislative, budgetary and oversight for Sulawesi
provinces, districts, and municipalities DPRDs. *

Unlike in the past when DPRDs were viewed as rubber stamps of the central
government, devolution of functions to the regions has greatly increased
DPRD powers. They not only make local rules and regulation (PERDA's), but
the role to monitor and oversee the local governments. As stated in Law
32/2004, DPRD's has obligation and authority to conduct oversight of
implementation PERDA's and other regulations, decision of governor
regents/mayors, implementation local budget, local executive policy and
implementation with respect to international cooperation in the region. The
provision strengthens not only the role of DPRD in policy-making, but also
its authority to monitor local government and other officials. The DPRD
oversight aims at establishment of institutional checks and balances between
DPRD and local executive. People are increasingly aware of the DPRD's role
in monitoring government activities as part of their duties to represent the
interest of society. Though the awareness is not yet widespread, it has
pushed the DPRDs to act on complaint and grievances expressed by their
constituents with respect to local policies and the quality of public
services.

*In practice the oversight duties and obligations are rarely performed with
efficiency and effectiveness in many DPRD in the regions of Indonesia.
Perceptions differ as to what the DPRD's monitoring functions are. There is
no agreement on the scope and intensity of monitoring that could guide DPRDs
in exercising these functions. Local government thinks that the DPRD should
monitor only implementation of priority programs at the policy level, not at
the technical level. In contrast, the DPRD's believe that their oversight
function encompasses both levels. Indeed, in the even plenary session when
the head of regional government deliver the accountability speech, more
elaborate supervision mechanism are still absent and often it is unclear how
the executive is best questioned/probed.*

*There are also challenges face by DPRD to conduct effective DPRDs oversight
functions, e.g.; Insufficient capacity – DPRDs lack necessary knowledge and
skills to conduct oversight effectively; Uneven coverage – DPRD monitoring
function does not extent equally to all sectors of government. It occurs
mostly in areas that involve large expenditures, such as physical
infrastructure and investment. Monitoring of public services provision is
still sufficiently rigorous, and has not extended to the wider impact of
policy implementation. In many cases this has resulted in decreased
accountability, participation and public services provision; insufficient
enforcement of the law – There are indications that efforts to uphold the
law are still weak. For example, there are reports that DPRD members act in
the interest of their political parties or factions, as opposed to the
interest of the people. This renders the monitoring function ineffective. .

*GRADE Project has recently received a request from the Provincial DPRD of
Central Sulawesi to support their oversight performance. Based on these
needs, GRADE Project will provide technical facilitation for Provincial DPRD
of Central Sulawesi oversight capacity strengthening.*

*OBJECTIVES *

* *

*In general the objective of this DPRD oversight facilitation is to improve
the capacity of Central Sulawesi DPRDs to conduct effective oversight duties
and obligations. The oversight facilitation aims:*

*1)* *To assist DPRD to have clear perception and understanding on the
DPRD oversight/monitoring functions in order to avoid differ perceptions on
the scope of oversight or supervision which are other institution the domain
(e.g. Bawasada, BPKP etc). *

*2)* *To foster effective DPRD oversight and improve DPRD performance *

* *

*SCOPE OF WORKS *

* *

*1)* *Assessment on Central Sulawesi DPRDs needs to perform effective
oversight duties/obligation.*

*2)* *Developing oversight technical guidance for DPRD.*

*3)* *Conducting workshop to have inputs on the guidance and formulating
technical facilitation agenda that are in mutual accord with the DPRD
oversight work plan.*

*4)* *Providing onsite technical facilitation for Central Sulawesi DPRD
in the event of hearing, filed visit/trips, task of special committee
(pansus) and working committee (panitia kerja).*

*5)* *Reporting on the technical facilitation activities*

* EXPECTED OUTPUTS *

* *

*1)* *Oversight Technical Guidance for Central Sulawesi DPRD. This
guidance is expected could be utilized and desseminated to DPRD in other
region. *

*2)* *Improved understanding of Central Sulawesi DPRD on
oversight/monitoring
functions.*

*3)* *Workshop for DPRD oversight technical guidance and formulation of
technical facilitation agenda. *

*4)* *Technical facilitation for Central Sulawesi DPRD to perform
effective oversight*

* THE REQUIRED EXPERTS *

* *

*This DPRD oversight facilitation required 2 experts as follows:*

*1)* *Local Government experts;*

*a.* *Master's Degree or equivalent (S2) in Public Administration,
Economics, Political Sciences, Social Sciences or related field. *

*b.* *Five (five) years of relevant experience at the national level
in relevant areas such as monitoring and evaluation, and public audit. *

*c.* *Prior to technical facilitation experiences particularly on
assistances or empowerment of DPRD. *

*d.* *Having experience in designing and developing capacity
enhancement material for DPRD. *

*e.* *Demonstrated knowledge and experience in working on the relevant
thematic area. *

*f.* *Experience in working with government agencies (central and
local), civil society organizations and international organizations are an
asset. *

*g.* *Experience in the usage of computers and office software
packages. *

*h.* *Fluency in written and spoken English and Indonesian.*

*2)* *Institutional and Public Law experts *

*a).* *Master's Degree or equivalent (S2) in Law, Social Sciences or
related field.*
